Transformation Institute - Terms of Service Agreement and Affidavit of Acceptance

Transformation Institute is An Unincorporated Private Eleemosynary Society
Unincorporated: not acting as a legal entity; not existing under any government authority.
Private: Conducted and supported primarily by individuals or groups not affiliated with
government agencies or corporations.
Eleemosynary: Of, relating to, or supported by benevolence, charity and goodwill.
Society: An organization or association of persons engaged in a common profession, activity, or
interest.
This Membership Contract is between _____________, a living man/woman (referred to hereafter as "The Member") and Transformation Institute (hereafter referred to as "Transformation Institute"), an unincorporated private eleemosynary society.
Transformation Institute operates an online membership platform for educational purposes (hereafter referred to as "Membership Platform") where Members of Transformation Institute can access educational resources, and engage in discussions with teachers and fellow students.
Transformation Institute Mission Statement – Our Creed
Transformation Institute educates, empowers, and unites men and women from all walks of life in pursuit of health, freedom, and greater spiritual growth and awareness. Through courses, conference calls, and other communications, we focus on challenging false, dysfunctional, and destructive governmental, institutional, and cultural programming, while charting a path towards health, freedom, and greater awareness for all of humankind. Transformation Institute's private membership platform enables men and women interested in health, freedom, and greater conscious awareness to connect, both virtually and in person, to learn, collaborate, share ideas, and help each other grow into honorable, confident, and productive adults.
Our Values
By signing this Contract, The Member agrees to embrace and follow these values when interacting with and through Transformation Institute:
Respect: Treat all members of Transformation Institute with dignity and respect, recognizing
other members as brothers and sisters of our online society.
Freedom: Recognize and refrain from infringing upon the lives, choices, and property of other
members.
Integrity: Act with honesty and transparency in all interactions.
Accountability: Take full ownership of your own thoughts, feelings, and actions.
Compassion: Seek to understand the state of consciousness and level of knowledge of other
members when interacting. Express goodwill, and cultivate support for one another.
Community Building: Foster connection, collaboration, and mutual support amongst the
Transformation Institute community of students, teachers and assistants.
Continuous Learning: Foster a culture of continual learning, self-improvement, and growth,
remaining open to the mystery of life with an open, child-like curiosity.
Non-Violent Communication: Promote communication that is honest, clear, and respectful, without
resorting to aggression or coercion. Individual opinions often differ. Refrain from attacking an individual, or
engaging in logical fallacies in disputes. Instead focus on mutually agreeable facts and common ground for
effective, lasting communication.
Member Acknowledgment
By signing this Contract, The Member acknowledges that s/he agrees with the above mission statement and values of Transformation Institute.
The Members of Transformation Institute hereby declare that their primary objective is safeguarding and enhancing the Health, Natural Law rights, and Freedom/Liberty of its members.
Transformation Institute firmly upholds the Unalienable Natural Law Rights of every Member. These include freedom of speech, the right to petition for redress of grievances, the right to assemble, the right to form contracts, the right to congregate for the lawful purpose of advocating for and assisting one another in asserting their rights, and all other unspecified unalienable rights granted by God, and further described in federal and state constitutions, and statutes. We are dedicated to preserving and enhancing the civil rights, constitutional guarantees, freedom of choice in healthcare, political freedom, and individual liberty for every member within our organization.
IT IS HEREBY DECLARED that we – the men and women of Transformation Institute, and all its Members, are exercising our right of "freedom of association." This means that our Association activities are restricted to the private domain.
Transformation Institute will recognize any man or woman (irrespective of race, color, or religion) who is in agreement with these principles (creed) and policies as a private member, with Transformation Institute providing an online medium through which its individual members may associate for studying, discussing, and bringing to fruition the principles and purposes previously declared.
Membership Contract
This Contract governs The Member's participation in the Membership Platform offered by "Transformation Institute."
1. Membership Privileges: Transformation Institute hereby grants The Member access to the private, online Membership Platform, which provides educational content and resources; enables members to engage in discussions, send and receive messages to other members, participate in conference calls with teachers, locate other members by country/state/province/city (on an opt-in basis), and other features.
The Member acknowledges that the Membership Platform is solely for their own personal use and is not transferable.
2. Accountability and Responsibility: The Member acknowledges that they are solely and fully accountable for their own actions, choices, and decisions both during and after their use of information provided by Transformation Institute, as well as any relationships established with other members of Transformation Institute, Transformation Institute partners, and other relationships formed through the Membership Platform. The Member agrees that Transformation Institute shall not be liable or responsible for any actions taken by the Member.
3. Non-Aggression Principle: The Non-Aggression Principle (NAP) is an ethical and moral principle that aims to avoid conflict between people by way of each man, woman, and children in a given community agreeing to refrain from committing acts of aggression or threatened acts of aggression against any other man, woman, or child. The behaviors that are prohibited by the NAP are ma/um in se (Latin: evil in itself), as opposed to behaviors that are prohibited due to laws, social norms, or moral systems. This principle states that aggression is a form of encroachment on another man, woman, or child's life, liberty, or property, or an attempt to obtain what could not be obtained consensually from another man, woman, or child, or any threat thereof.
The Member agrees to abide by the NAP, and vows to do no harm to others, and refrain from threatening harm to others. The Member shall not engage in any behavior or communication that could be considered abusive, threatening, or harmful towards any other member or representative of Transformation Institute.
4. Dispute Resolution: In the event of a controversy or dispute involving any Member, the Member may call upon the other members or representatives of Transformation Institute to mediate and assist in finding a peaceful, fair, and just resolution.
Should that effort not be productive, the Member agrees to seek Alternative Dispute Resolution (ADR) within Transformation Institute in the form of Binding Mediation or Arbitration at the choice of the complaining party within the established framework, established in accord with the premises of the case of NLRB v. CATHOLIC BISHOP OF CHICAGO, 440 U.S. 490 (1979) and Watson v. Jones, 80 U.S. 679 (1871), shall apply herein.
All internal disputes of The Members of Transformation Institute and contracts exterior to this Republic-based organization shall be resolved in private ADR in accordance with the premises of P.L. 97-280 (96 Stat. 1211), St. Nicholas Cathedral v. Kedroff, 363 U.S. 190 (1960), Henry Schein, Inc. v. Archer & White Sales, Inc., 586 U.S. ___ (2019), the Federal Arbitration Act, the Religious Freedom Restoration Act, Univ. of Great Falls v. Natl. Labor Relations Board, DC Ct. Appeals 00-1415 (2002), Stevens v. Berger, 428 Fed. Sup. 896 (1977), and Bryce v. Colorado District Church of the Nazarene, No. 00-1515 (10 Cir. 2002).
5. Hold Harmless and Release of Liability: The Member acknowledges that Transformation Institute and its official representatives are providing educational content and information in good faith, and they do so without any warranties or guarantees. The Member acknowledges that Transformation Institute and its official representatives shall not be liable for any claims, damages, or losses arising out of or in connection with The Member's use of the Membership Platform. The Member agrees to release and hold harmless Transformation Institute and its official representatives from any and all claims, demands, or causes of action arising out of, or in connection with such use or participation in the Membership. In no event shall Transformation Institute be liable for any damages or losses, including but not limited to direct, indirect, incidental, consequential, or special damages.
Additionally, any request by The Member to a fellow member to assist him/her or provide him/her with any diagnosis, therapy, treatment, care, legal process, or financial advice is his/her own free decision in an exercise of his/her rights and made by him/her for their own benefit. All liability in such cases remains with The Member.
6. Non-Disclosure Agreement (NDA): The Member acknowledges that the information provided within the Membership Platform is confidential and proprietary to Transformation Institute. As such, The Member agrees to keep all such information, discussions, or any other content accessed or provided by the Membership Platform confidential, and not disclose it to any third party without the express written permission of Transformation Institute. This includes the agreement not to copy and share information from the Membership Platform to family, spouse, friends, co-workers, employees, and any other non-members. The Member acknowledges that breach of this NDA may result in legal consequences.
Information that cannot be shared under the NDA is as follows:
- Videos: All videos on this site are proprietary and may not be shared, copied, or reproduced.
- All Text, Documents, Content, and Language including, but not limited to, Courses, Programs, Student Handouts,
Media Library contents, transcripts, Q&A sessions, newsletters, videos, website pages, posts in community
forums, and all educational examples and exhibits.
- Members' names, identities, and any other information found on the website or in the community forums.
Information that can be shared under the NDA is as follows:
- Any information being shared with the general public that we may also share within the platform.
- Public documents housed within our Content Library that are found on the internet.
- Generally known public information and processes that can be found on the internet.
- Educational, scientific, and legal theories known to the public.
- For non-member introductions: The private nature of Transformation Institute Unincorporated Private-Based
Eleemosynary Society.
- That we are a group of private men and women educating and sharing ideas with one another on various concepts
surrounding the pursuit of health, freedom, and greater spiritual awareness.
The Member acknowledges that the activities within Membership Platform are a private matter that s/he refuses to share with the State Medical Board, FDA, CDC, FTC, Medicare, Medicaid, DOJ, or other government agencies of the CORPORATE MUNICIPAL LAW FORM without the expressed specific permission of Transformation Institute. All records and documents remain as property of Transformation Institute, even if The Member receives a copy of them. The Member fully agrees not to file a malpractice lawsuit or other legal suit against a fellow member of Transformation Institute unless that member has exposed The Member to a clear and present danger of substantive evil. The Member acknowledges that the members of Transformation Institute do not carry malpractice insurance.
In order to maintain the trust and privacy of our Membership Platform, by signing this agreement, The Member acknowledges the fundamental importance of confidentiality and privacy. Should the Member breach the NDA by disclosing any private information, discussion, or any other content accessed or provided by the Membership Platform, The Member acknowledges and agrees that s/he may be required to pay compensation to Transformation Institute Partnership and/or any other member whose right to privacy was breached.
The amount payable will be determined solely by Transformation Institute at its sole discretion. Transformation Institute understands that mistakes can happen. In the event that The Member accidentally shares confidential information or discussions from the Membership Platform, Transformation Institute agrees to engage in a constructive dialogue with The Member in an attempt to resolve the issue amicably, before pursuing any lawful remedies or requiring payment. The action taken by Transformation Institute will be determined on a case-by-case basis, taking into account the severity of the breach and The Member's intentions.
The Member acknowledges that the NDA portion of the contract will remain in effect for the remainder of their lives, irrespective of whether they cancel their membership with Transformation Institute Partnership.
7. Links from the Website: If the Website contains links to other sites and resources provided by third parties, these links are provided for your convenience only. We have no control over the contents of those sites or resources, and accept no responsibility for them, or for any loss or damage that may arise from your use of them. If you decide to access any third-party websites linked to the Website, you do so entirely at your own risk and subject to the terms and conditions of use for such third-party websites.
8. Linking to the Website and Social Media Features: You may link to our homepage, provided you do so in a way that is fair and lawful, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part. The Website may provide certain social media features that enable you to:
a. Link from your own or certain third-party websites to certain content on the Website
b. Send e-mails or other communications with certain content or links to specific content on the Website
c. Cause limited portions of content on the Website to be displayed or appear to be displayed on your own or
certain third-party websites You may use these features solely as they are provided by us and solely with
respect to the content they are displayed with, and otherwise in accordance with any additional terms and
conditions we provide with respect to such features.
Subject to the foregoing, you must not:
a. Establish a link from any website that is not owned by you
b. Cause the Website or portions of it to be displayed, or appear to be displayed, by, for example, framing,
deep linking, or in-line linking on any other site
c. Link to any part of the Website other than the homepage
d. Otherwise take any action with respect to the materials on the Website that is inconsistent with any other
provision of these Terms. The website from which you are linking, or on which you make certain content
accessible, must comply in all respects with the Content Standards set out in these Terms. You agree to
cooperate with us in causing any unauthorized framing or linking to cease immediately. We reserve the right to
withdraw linking permission without notice. We may disable all or any social media features and any links at any
time without notice at our discretion.
9. Copyright Infringement: We take claims of lawful copyright infringement seriously. We will respond to notices of alleged copyright infringement where appropriate. If you believe any materials accessible on or from the Website infringe your copyright, you may request removal of those materials (or access thereto) from the Website by submitting written notification to our Copyright Agent (designated below). In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512) ("DMCA"), the written notice (the "DMCA Notice") must substantially include the following:
a. Your physical or electronic signature
b. Identification of the copyrighted work you believe to have been infringed or, if the claim involves multiple

10. Force Majeure: Transformation Institute will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations that are caused by events outside its reasonable control ("Force Majeure Event"). A Force Majeure Event includes any act, event, non- happening, omission, or accident beyond Transformation Institute's reasonable control including, but not limited to, restrictions of law, regulations, orders or other governmental directives, pandemics, labor disputes, acts of God, third party mechanical or other equipment breakdowns, terrorist attacks, fire, explosions, fiber optic cable cuts, interruption or failure of telecommunications or digital transmission links, internet failures or delays, storms, or other similar events.
11. Term and Termination: The Member may terminate his/her membership at any time by following the instructions provided in Transformation Institute's Membership Platform or by contacting contact@transformationinstitute.org
Transformation Institute may terminate your membership at any time, with or without notice, if you fail to comply with the terms and conditions of this agreement, or if we have substantial reason to believe that your actions are detrimental to Transformation Institute and/or its members.
12. Jurisdiction: The Member understands the fellow members of Transformation Institute that provide services and care, whether legally, medically, or otherwise, do so in the capacity of a fellow member, and not in the capacity as a licensed health care provider or as a BAR registered attorney. The Member further understands that within Transformation Institute no doctor-patient or attorney-client relationship exists, but only a contracted member-to-member relationship. In addition, The Member has freely chosen to act as private member of Transformation Institute. Any other legal status of The Member to other entities (such as doctor/patient or attorney/client), is outside their private relationship with Transformation Institute. The Member further understands that it is entirely his/her own responsibility to consider the advice and recommendations offered to him/her by fellow members and/or partners of Transformation Institute, and to educate themselves as to the efficacy, risks, and desirability of same, and the acceptance of the offered or recommended diagnosis, therapy, treatment, care or legal processes, is his/her own carefully considered decision.
In addition, The Member understands that since Transformation Institute is an unincorporated private-based organization under common law, protected by the First and Fourteenth Amendments of the Constitution, it is outside the jurisdiction and authority of Federal and State Agencies and Authorities (see Title 31 CFR 363.6, "minor," and 50 USC 4312, "common-law trustee") concerning any and all complaints or grievances against Transformation Institute, any partner(s), members or other staff persons. All rights or complaints or grievances will be settled by a Committee (Alternative Dispute Resolution) brought forth by Transformation Institute for the benefit of the Association and its members.
13. Sharing of Advice or Counsel Between Members: The Member understands that should doctors, nurses, coaches, legal pundits, and other providers who are fellow members of Transformation Institute, who may privately offer The Member advice, services, and benefits that do not necessarily conform to conventional medical care or legal guidance, The Member assumes full responsibility for their use of such advice. The Member does not expect these benefits to include on-call coverage, hospital care, or the usual and customary care provided by most physicians or attorneys. The Member will receive such primary and specialist care and legal guidance elsewhere.
14. Controlled Operatives: The Member agrees and acknowledges that s/he is not a government agent, is not acting as a government agent, is not contracting with the government with a focus on gathering intelligence information, and is not entering the organization with the intention of writing a story, blackmailing, framing, or causing disruption within the organization.*
*Note: This clause is intended to cover all possible scenarios where the member may be involved in activities related to the government, intelligence gathering, or the conventional media. It serves as a safeguard to protect the privacy and integrity of the organization and its members.
15. Competitive Activities: The Member acknowledges that s/he may not use the Transformation Institute Confidential Information to compete with Transformation Institute directly or indirectly, or to engage in any other related competitive activities.
16. Modifications: Transformation Institute may modify this Contract at any time by updating this document on the Membership Platform and notifying all members. Prior to releasing the updated Contract, Transformation Institute agrees to host a Zoom/Live Video Call open to all members of Transformation Institute in order to openly discuss the changes to the Contract. Transformation Institute and its representatives agree to remain open to feedback from all members.
17. Entire Contract: This Contract constitutes the entire agreement/contract between The Member and Transformation Institute regarding the subject matter hereof, and supersedes all prior agreements, contracts, understandings, and representations, whether oral or written, between the parties.
In regards to interpretation of this contract, Government Administrative Regulatory agencies are no longer allowed to act with impunity as shown in the cases that have overturned the administration presumptions of the case of Chevron U.S.A. v. Natural Res. Def. Council, 467 U.S. 837 (1984). The (U.S. Supreme Court) justices took up their appeals, agreeing to address only the Chevron question in Relentless v. Department of Commerce, 22-1219, 1st Cir., Jan 17, 2024, Jun 28, 2024, wherein, "The Administrative Procedure Act requires courts to exercise their independent judgment in deciding whether an agency has acted within its statutory authority, and courts may not defer to an agency interpretation of the law simply because a statute is ambiguous; Chevron v. Natural Resources Defense Council is overruled."
Further, Loper Bright Enterprises v. Raimondo, 22-451, D.C. Cir., Jan 17, 2024, Jun 28, 2024, wherein, "Holding: The Administrative Procedure Act requires courts to exercise their independent judgment in deciding whether an agency has acted within its statutory authority, and courts may not defer to an agency interpretation of the law simply because a statute is ambiguous; Chevron v. Natural Resources Defense Council is overruled."
Also, the case of Depart of Ag. Rural Development v. Kirtz, U.S. Supreme Court, No. 22-846, wherein, "holding that 15 U. S. C. §§1681n and 1681o authorize suits for damages against "any person" who violates the FCRA, and §1681a expressly defines "person" to include "any" government agency. 46 F. 4th 159, 164–166." Therein, ". . . the FCRA clearly waives sovereign immunity in cases like this one."
Execution
The Member acknowledges that they have read and understood the terms and conditions of this Contract.
By agreeing with the terms and conditions of this Contract on the checkout page, the Member is bound by to this Contract and hereby electronically signs this Contract. The Member acknowledges that their digital signature represents an official wet-ink signature and binds them legally to the terms and conditions set forth herein.
